The terms that govern your use of this site, our forms, and the products described here.
On this page
These Terms include a binding arbitration provision, a class action waiver, and a jury trial waiver (see "Binding arbitration and class action waiver" below). They affect how disputes between you and Kings Funding are resolved.
These Terms and Agreements (the "Terms") govern your use of kingsfg.com (the "Site") and the forms, content, and services available through it. The Site is operated by Kings Funding LLC ("Kings Funding," "we," "us," or "our"). By visiting the Site, submitting a form, or contacting us, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, please do not use the Site.
If you use the Site on behalf of a business, you agree to these Terms for yourself and for that business, and "you" includes both. Any financing, partnership, or referral arrangement is governed by a separate signed agreement. If these Terms conflict with a signed agreement, the signed agreement controls for that relationship.
Kings Funding provides working capital to small businesses and connects business owners with lending and payment partners. Products described on the Site may be offered by Kings Funding directly or through funding partners and lenders we work with.
Product descriptions, ranges, timelines, and examples on the Site are general information. They do not describe the terms available to any specific business.
Nothing on the Site, and no application, inquiry, pre-qualification, estimate, or conversation with our team, is an offer, approval, or commitment to provide financing or any other product. Every request is subject to underwriting, verification, and a separate written agreement, and we or our partners may decline any request. Where state commercial financing disclosure laws apply, the required disclosures are provided with an offer, before you sign.
You must be at least 18 years old to use the Site or submit a form. When you submit an application or inquiry on behalf of a business, you represent that you are an owner or authorized representative of that business, that you have the authority to bind it, and that the business will use any financing for business purposes and not for personal, family, or household purposes. When you submit a home equity inquiry, you represent that you own the property described.
You agree that everything you provide to us, including documents, is true, accurate, and complete, and that you will promptly tell us about any material change. We and our partners rely on this information. Providing false or misleading information may result in denial, termination of any agreement, and liability under federal and state law, and we may report suspected fraud to law enforcement, regulators, and industry fraud databases. The certifications, credit and information authorizations, and consents you accept when you submit an application or inquiry are part of these Terms and remain in effect as described there. We may verify anything you tell us and may decline any request without giving a reason, subject to applicable law.
You agree to do business with us electronically. That includes receiving records, notices, and disclosures electronically, and signing applications and other documents with an electronic signature, which has the same legal effect as a handwritten signature under the federal Electronic Signatures in Global and National Commerce Act and applicable state law. To receive electronic records you need a device with internet access, a current browser, an email account you can access, and the ability to view and save PDF files. You may request a paper copy of any record, or withdraw your consent to electronic records, by contacting us at team@kingsfg.com. Withdrawing consent may prevent us from processing a pending request.
By providing a phone number or email address, you agree that Kings Funding and its funding or lending partners may contact you about your request, any financing, and related products and services by live call, prerecorded or artificial voice message, automatic telephone dialing system, text message, and email, even if your number is listed on a Do Not Call registry. Consent is not a condition of receiving any product, and message and data rates may apply. Reply STOP to end text messages, use the unsubscribe link in any marketing email, or contact us to withdraw consent to calls or emails.
You represent that you are the subscriber or customary user of any phone number you give us and that you are authorized to consent to contact at that number. If you give up or change a number, you agree to tell us promptly. Calls with Kings Funding may be monitored or recorded for quality, training, verification, and compliance purposes, and by speaking with us you consent to that recording.
When you opt in to text messages from Kings Funding, you may receive messages about your application, inquiry, or account, requests for documents, updates on funding, and offers for related products and services. Message frequency varies. Message and data rates may apply. Reply STOP at any time to cancel, and reply HELP or email team@kingsfg.com for help. Wireless carriers are not liable for delayed or undelivered messages. Mobile phone numbers and text message opt-in information are not shared with third parties or affiliates for their own marketing purposes.
ISOs, brokers, and referral partners who submit files through the Site or to our team must have the merchant's authorization to share its information and obtain financing on its behalf, and must comply with all applicable laws, including licensing, disclosure, telemarketing, and marketing laws. Commissions, submission requirements, and other terms are governed by the partner agreement between Kings Funding and the partner. We may decline any submission and may end a partner relationship at any time in accordance with that agreement. Partners are independent businesses, not employees or agents of Kings Funding, and we are not responsible for their statements or conduct.
Using the Site, submitting a form, or speaking with our team does not make Kings Funding your agent, broker, advisor, or fiduciary. When we introduce you to a lender, payment processor, or funding partner, we may be paid a referral fee or commission by that partner, and we may have a financial interest in advances we fund. You are responsible for evaluating any product and its terms, and for deciding whether it is right for your business.
The Site and its content, including text, graphics, logos, page designs, forms, and software, belong to Kings Funding or its licensors and are protected by copyright, trademark, and other laws. The Kings Funding name and logo are our trademarks. You may view and print pages of the Site for your own business use in considering our products. You may not copy, modify, distribute, display, sell, or create derivative works from the Site or its content without our written permission.
You agree not to use the Site to submit information that is false or that you are not authorized to share, to apply on behalf of a business or person without authority, to interfere with the Site's operation or security, to scrape, harvest, or collect data from the Site by automated means, to introduce malicious code, to impersonate any person or company, or to violate any law. We may suspend or block access to the Site for any violation.
The Site may link to, or require you to use, websites and applications operated by lenders, payment processors, and other third parties. Those services are governed by their own terms and privacy policies. We do not control them and are not responsible for their content, products, or practices. A link on the Site is not an endorsement.
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or secure, or that information on it is complete or current.
Content on the Site is general information about business financing. It is not legal, tax, accounting, or financial advice, and it is not a recommendation for any specific business. Consider consulting your own advisors before entering into any financing. Funding amounts, approval times, and other figures on the Site describe what may be available in some cases and are not promises about any request. Nothing on the Site is an offer to sell or a solicitation of an offer to buy any security or investment, and Kings Funding does not offer securities to the public through the Site. Any capital participation opportunity is made only to eligible persons under separate written agreements.
To the fullest extent permitted by law, Kings Funding and its owners, officers, employees, agents, funding partners, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to the Site or these Terms, even if advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Site or these Terms will not exceed one hundred dollars ($100). These limits do not apply to liability that cannot be limited under applicable law, and they do not limit either party's obligations under a signed financing or partner agreement.
You agree to defend, indemnify, and hold harmless Kings Funding and its owners, officers, employees, and agents from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the Site, information you submit, your violation of these Terms, or your violation of any law or the rights of another person.
Please read this section carefully. It requires you to resolve disputes with Kings Funding through individual arbitration and waives your right to a jury trial and to participate in a class action.
You and Kings Funding agree that any dispute, claim, or controversy arising out of or relating to the Site, these Terms, the Privacy Policy, any application, inquiry, or form submitted through the Site, or any communication between you and Kings Funding or its partners about the Site or its products (including calls, texts, and emails), whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and including any dispute about the scope, interpretation, or enforceability of this section, will be resolved by binding individual arbitration and not in court. This agreement to arbitrate is governed by the Federal Arbitration Act.
Either party may bring an individual claim in small claims court if it qualifies. Either party may seek an injunction or other equitable relief in court to protect its intellectual property or to stop unauthorized use of the Site. Disputes under a signed financing, syndication, or partner agreement are governed by the dispute terms in that agreement.
The arbitration will be administered by the American Arbitration Association ("AAA") under its rules in effect when the claim is filed, including its Consumer Arbitration Rules where they apply, before a single neutral arbitrator. AAA rules are available at adr.org. The arbitrator may award the same individual relief a court could award, must follow applicable law, and will issue a reasoned written decision. Hearings will take place in Pinellas County, Florida, by video conference, or at another location the parties agree on, and the arbitrator may decide a dispute on written submissions where the rules allow. Each party pays its own attorneys' fees and costs unless the arbitrator awards them under applicable law, and filing and arbitrator fees are allocated under the AAA rules. Judgment on the award may be entered in any court with jurisdiction.
You and Kings Funding agree to bring claims only in an individual capacity, and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding. If for any reason a claim proceeds in court rather than in arbitration, you and Kings Funding each waive any right to a jury trial.
You may opt out of this arbitration agreement by emailing team@kingsfg.com within 30 days after you first agree to these Terms, with the subject line "Arbitration opt-out," your name, your business name, and the phone number and email you used on the Site. Opting out does not affect any other part of these Terms.
If any part of this section is found unenforceable, the rest of the section remains in effect, except that if the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court under "Governing law and venue" below and will be stayed pending arbitration of any remaining claims. This section survives the end of your relationship with Kings Funding.
These Terms and any dispute arising out of or related to the Site are governed by the laws of the State of Florida and applicable federal law, without regard to conflict of laws rules. For any matter that is not subject to arbitration, you agree that the state and federal courts located in Pinellas County, Florida have exclusive jurisdiction, and you consent to personal jurisdiction and venue in those courts. Disputes under a signed financing or partner agreement are governed by the dispute terms in that agreement.
We want the Site to be usable by everyone. If you have difficulty using any part of the Site or a form, contact us at team@kingsfg.com and we will help you complete your request another way, including by phone.
We may update these Terms from time to time. The current version will always be posted on this page. Changes take effect when posted, and your continued use of the Site after a change means you accept the updated Terms. Changes to the arbitration section do not apply to a dispute that either party has already notified the other of in writing.
These Terms, together with the Privacy Policy and the certifications and consents accepted in any form you submit, are the entire agreement between you and Kings Funding regarding the Site. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. There are no third-party beneficiaries of these Terms other than Kings Funding's affiliates, owners, officers, employees, agents, and partners as expressly stated. We are not liable for any delay or failure caused by events beyond our reasonable control, including outages, carrier or hosting failures, and government action. Sections that by their nature should survive (including accuracy of information, intellectual property, disclaimers, limitation of liability, indemnification, arbitration, and governing law) survive any termination of these Terms or your use of the Site.
The Site is operated from the United States and is intended for businesses and individuals located in the United States. Any suggestion, idea, or feedback you send us about the Site or our products may be used by us without obligation to you. We may suspend or end your access to the Site at any time, and we may give you notices electronically, including by email or by posting on the Site.
