How we collect, use, share, and protect your information, and the choices you have.
On this page
Kings Funding LLC ("Kings Funding," "we," "us," or "our") provides working capital to small businesses and introduces business owners to lending and payment partners. This Privacy Policy explains what information we collect through kingsfg.com (the "Site"), our online forms, and our conversations with you by phone, text, and email, how we use it, who we share it with, and the choices you have.
This policy applies to visitors of the Site, business owners and their representatives who apply for funding or submit an inquiry, ISOs and brokers who work with us, and anyone who contacts us. Financing agreements, partner agreements, and any lender's own application carry their own terms, which control for those relationships.
When you use the Site or submit a form, we and our service providers may record your IP address, browser and device type, the pages you visit, the page a form was submitted from, referring URLs and campaign parameters, and the date and time of your visit or submission. We keep a record of the consent language you accepted and when, which we use to document your authorizations.
With the authorizations you give us in an application or inquiry, we obtain information from consumer reporting agencies (such as Experian, Equifax, and TransUnion), business credit and background reporting services, bank account data and verification services, identity verification and fraud prevention providers, public records, and the banks, creditors, payment processors, landlords, accountants, and other third parties you authorize to release information. If an ISO, broker, or referral partner submits your file, we receive your information from them. Funding partners and lenders may also share information with us about the status of a file they received from us.
We share information only as described here.
We do not sell your personal information for money. Because some partners compensate us for introductions, the laws of certain states may treat those introductions as a "sale" or "sharing" of personal information. If that applies to you, you can opt out as described under "Your choices and rights" below.
When you provide a phone number or email address in an application or inquiry, you agree that Kings Funding and its funding or lending partners may contact you about your request, any financing, and related products and services, including by live call, prerecorded or artificial voice message, automatic telephone dialing system, text message, and email, even if your number is on a federal or state Do Not Call registry. That consent is not a condition of receiving funding, and message and data rates may apply.
You can stop text messages at any time by replying STOP. You can unsubscribe from marketing emails using the link in any message, and you can withdraw consent to calls or emails by contacting us at team@kingsfg.com. We may still contact you about an active application, account, or legal matter. Calls with us may be monitored or recorded for quality, training, verification, and compliance purposes.
Mobile phone numbers and text message opt-in information are not shared with third parties or affiliates for their own marketing purposes. They are used only to send you the messages you agreed to receive and to deliver the products you asked about.
The Site uses only the cookies and similar technologies needed for it to work, along with any analytics tools we use to understand traffic and improve the Site. Analytics tools may set cookies and collect information such as your IP address, pages viewed, and approximate location. You can control cookies through your browser settings, although some parts of the Site may not work as intended if cookies are disabled. The Site does not currently respond to "Do Not Track" browser signals. Where the law requires it, we honor opt-out preference signals such as Global Privacy Control.
We use administrative, technical, and physical safeguards designed to protect your information, including encryption of data in transit, access limited to people who need it to do their jobs, and vendors that maintain their own security programs. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a security incident affects your information, we will notify you and the appropriate authorities as required by law. Please do not send Social Security numbers, full account numbers, or other sensitive details through the contact form or by unencrypted email unless we ask you to.
We keep information for as long as needed for the purposes described in this policy, which includes the life of any application, financing, or partnership, the period required by record-retention, credit, and anti-fraud laws, and any period needed to resolve disputes or enforce agreements. When information is no longer needed, we delete it or de-identify it.
You can ask us at any time to access, correct, or delete the personal information we hold about you, or to stop marketing communications, by emailing team@kingsfg.com. We may need to verify your identity before acting on a request, and we may keep information we are required to retain by law or that we need to complete a transaction you asked for.
Depending on where you live, state privacy laws may give you additional rights, such as the right to know what personal information we collect and how it is used, the right to delete or correct it, the right to opt out of the sale or sharing of personal information or its use for targeted advertising or profiling, the right to limit the use of sensitive personal information, the right to a portable copy, and the right not to be treated differently for exercising these rights. Some of these laws do not apply to information collected in connection with a financial product or covered by the federal Fair Credit Reporting Act or Gramm-Leach-Bliley Act. You may use an authorized agent to submit a request on your behalf, and if we decline a request you may ask us to reconsider. To exercise any of these rights, email team@kingsfg.com with "Privacy request" in the subject line. We respond within the time required by the law that applies to you.
This section supplements the rest of this policy for residents of states with comprehensive privacy laws. In the past 12 months we have collected the following categories of personal information, from the sources and for the purposes described in "Information we collect" and "How we use information":
We disclose these categories to the recipients described in "How we share information." Because some funding and lending partners compensate us for introductions, our disclosure of identifiers, financial information, and commercial information to those partners may be treated as a "sale" or "sharing" of personal information under some state laws. We do not knowingly sell or share the personal information of anyone under 16. To opt out, email team@kingsfg.com with "Do not sell or share my personal information" in the subject line. Opting out may limit the products we can offer you. We also honor opt-out preference signals, such as Global Privacy Control, where the law requires it.
Residents of Nevada may request that we not sell their covered information by emailing the same address. We retain each category of personal information for the periods described in "How long we keep information."
Business financing products offered by Kings Funding are commercial products, and the personal information of business owners collected in connection with them is handled as described in this policy. If you obtain a consumer financial product, such as a home equity line of credit, through one of our lending partners, that lender will provide you its own privacy notice under the Gramm-Leach-Bliley Act and applicable state law, and its notice governs the information it collects from you.
The Site and our services are intended for business owners and adults. We do not knowingly collect information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
The Site may link to partner websites, and completing a product with a lender or payment processor may require an application on that partner's own platform. Those sites and applications are governed by their own privacy policies and terms. We are not responsible for the privacy practices of other companies, and we encourage you to read their policies before providing information.
The Site is operated from the United States and is intended for businesses and individuals located in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your location.
We may update this policy as our services, partners, or the law change. When we do, we will post the new version on this page and update the "last updated" date at the bottom. If a change materially affects how we use information you have already given us, we will notify you by email or through the Site before it takes effect.
